This Public Offer (the “Offer”) is an official proposal from TgSuperGifts (the “Service”) to conclude a sales agreement for digital assets (NFTs) with any user who accepts the terms of this Offer.
1. General Terms
1.1. By using https://tgsupergift.com, the user confirms that they have read and agreed to this Offer.
1.2. This Offer governs the purchase and transfer of NFTs listed on the Service.
2. Subject of Agreement
2.1. TgSuperGifts acts as an intermediary between the NFT seller and the buyer.
2.2. After payment is received, the Service purchases the selected NFT from the seller and transfers it to the buyer.
2.3. The buyer receives full ownership and usage rights of the NFT without limitations.
3. Payment and Delivery
3.1. Payments can be made on https://tgsupergift.com using bank cards, SBP, or cryptocurrency.
3.2. After payment, the NFT is automatically delivered to the Telegram account provided by the buyer.
3.3. The buyer is responsible for entering the correct Telegram account information.
4. Refunds
4.1. A refund is possible only if the NFT has not yet been purchased from the seller.
4.2. If the NFT has been successfully purchased, a refund is not possible.
4.3. If the user entered an incorrect Telegram account and the NFT was delivered, a refund is also not possible.
4.4. Once the NFT has been delivered (transferred) to the buyer’s specified Telegram account, refunds and cancellation of the transaction are not possible.
4.5. Deadline for submitting a refund request: a request must be submitted via the Telegram support bot @tg_super_support_bot within 14 (fourteen) calendar days from the date of payment. The request must state the order number, the date and time of payment, the amount and payment method, the recipient’s Telegram account and a description of the issue. Requests submitted after this period are not accepted for review.
4.6. Refund request review period: the Service reviews the request and issues a decision within 10 (ten) business days from the date it is received. The user is notified of the decision through the same channel used to submit the request; if the request is denied, the reason is stated. If verification requires data from a payment system, the Telegram or Fragment platforms, or a blockchain network, the review period may be extended, but by no more than up to 30 (thirty) calendar days, and the user is notified before the initial period expires.
4.7. Refund payout period: if the request is approved, the funds are transferred within 10 (ten) business days from the date of the decision. The refund is issued using the same payment method and to the same account details used for the original payment. The actual time for the funds to be credited depends on the issuing bank, the payment system or the blockchain network and may take up to 30 (thirty) calendar days from the transfer date.
5. Liability
5.1. TgSuperGifts is not responsible for the actions of third-party sellers or platforms.
5.2. The buyer is responsible for providing accurate data and for the safekeeping of the NFT after delivery.
5.3. The Service shall not be liable for any lost profits or for any indirect, incidental, consequential, or punitive damages arising out of the use of or inability to use the Service, including those related to changes in the market value, exchange rate, or liquidity of the NFT.
5.4. The Service shall not be liable for any failure or delay in the performance of its obligations caused by force majeure or by the actions of third parties, the Telegram or Fragment platforms, payment systems, or blockchain networks.
5.5. The Service’s aggregate liability to the user shall in any case be limited to the amount actually paid by the user for the relevant NFT.
