This Public Offer (the “Offer”) is an official proposal from TgSuperGifts (the “Service”) to conclude a sales agreement for digital assets (NFTs) with any user who accepts the terms of this Offer.
1. General Terms
1.1. By using https://tgsupergift.com, the user confirms that they have read and agreed to this Offer.
1.2. This Offer governs the purchase and transfer of NFTs listed on the Service.
2. Subject of Agreement
2.1. TgSuperGifts acts as an intermediary between the NFT seller and the buyer.
2.2. After payment is received, the Service purchases the selected NFT from the seller and transfers it to the buyer.
2.3. The buyer receives full ownership and usage rights of the NFT without limitations.
3. Payment and Delivery
3.1. Payments can be made on https://tgsupergift.com using bank cards, SBP, or cryptocurrency.
3.2. After payment, the NFT is automatically delivered to the Telegram account provided by the buyer.
3.3. The buyer is responsible for entering the correct Telegram account information.
4. Refunds
4.1. A refund is possible only if the NFT has not yet been purchased from the seller.
4.2. If the NFT has been successfully purchased, a refund is not possible.
4.3. If the user entered an incorrect Telegram account and the NFT was delivered, a refund is also not possible.
4.4. Once the NFT has been delivered (transferred) to the buyer’s specified Telegram account, refunds and cancellation of the transaction are not possible.
5. Liability
5.1. TgSuperGifts is not responsible for the actions of third-party sellers or platforms.
5.2. The buyer is responsible for providing accurate data and for the safekeeping of the NFT after delivery.
5.3. The Service shall not be liable for any lost profits or for any indirect, incidental, consequential, or punitive damages arising out of the use of or inability to use the Service, including those related to changes in the market value, exchange rate, or liquidity of the NFT.
5.4. The Service shall not be liable for any failure or delay in the performance of its obligations caused by force majeure or by the actions of third parties, the Telegram or Fragment platforms, payment systems, or blockchain networks.
5.5. The Service’s aggregate liability to the user shall in any case be limited to the amount actually paid by the user for the relevant NFT.
